custom fields at bottom of checkout form?

I’m using this suggested technique to force a terms and conditions on the checkout form:

The problem is it’s appearing below the “create profile” section and above the “billing” section. It doesn’t really flow correctly. I’d prefer this to be at the bottom of the form, as the last item before the submit button.

Anyway to accomplish this? Thanks.
